ANALISIS EFEKTIVITAS PENYELESAIAN SENGKETA DALAM PENGADILAN TATA USAHA NEGARA UNTUK MENINGKATKAN KEADILAN BAGI MASYARAKAT

Abstrak

Efektivitas penyelesaian sengketa dalam Pengadilan Tata Usaha Negara (PTUN) dengan tujuan meningkatkan akses keadilan bagi masyarakat. Dalam konteks sistem ketatanegaraan Indonesia yang didasarkan pada prinsip demokrasi, peran PTUN menjadi krusial dalam menjaga keseimbangan kekuasaan antara pemerintah dan masyarakat. Namun, beberapa permasalahan seperti lamanya waktu penyelesaian perkara, rendahnya kualitas putusan, dan masalah aksesibilitas bagi masyarakat telah mengurangi efektivitas PTUN. Faktor-faktor yang mempengaruhi efektivitas PTUN termasuk kejelasan regulasi, kapasitas institusi, aspek prosedural, dan budaya masyarakat. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan studi kepustakaan untuk menganalisis faktor-faktor tersebut. Hasilnya menunjukkan perlunya penyempurnaan regulasi, pengembangan SDM, peningkatan sarana-prasarana, dan efisiensi proses berperkara untuk meningkatkan efektivitas PTUN dalam memfasilitasi akses keadilan bagi Masyarakat.

The effectiveness of dispute resolution in the State Administrative Court (PTUN) with the aim of increasing access to justice for the community. In the context of Indonesia's constitutional system, which is based on democratic principles, the role of the Administrative Court is crucial in maintaining the balance of power between the government and society. However, several problems such as the length of time to resolve cases, the low quality of decisions, and accessibility issues for the public have reduced the effectiveness of PTUN. Factors affecting the effectiveness of the PTUN include regulatory clarity, institutional capacity, procedural aspects, and community culture. This research uses a normative legal research method with a literature study approach to analyze these factors. The results show the need for regulatory improvement, human resource development, infrastructure improvement, and efficiency of the litigation process to improve the effectiveness of the PTUN in facilitating access to justice for the community.
