Penelitian ini membahas perlindungan hukum bagi guru dalam menjalankan profesinya serta klasifikasi kekerasan terhadap peserta didik dari perspektif hukum. Latar belakang penelitian ini berawal dari semakin maraknya dugaan kasus kekerasan guru terhadap siswa yang memicu perdebatan antara perlindungan anak dan kewenangan guru untuk mendisiplinkan siswa. Penelitian ini menggunakan pendekatan perundang-undangan dengan metode penelitian hukum normatif, menganalisis bahan hukum primer, sekunder, dan tersier. Temuan penelitian menunjukkan bahwa guru berhak mendapatkan perlindungan hukum selama tindakannya dilakukan dalam lingkup tugas profesionalnya dan sesuai dengan peraturan perundang-undangan yang berlaku, sedangkan tindakan yang melampaui batas kewajaran dapat dikategorikan sebagai kekerasan yang memiliki konsekuensi pidana. Penelitian ini menekankan pentingnya adanya batas yang jelas antara tindakan disiplin dan kekerasan, serta perlunya kebijakan pencegahan melalui pendidikan hukum bagi guru dan penerapan pendekatan disiplin positif.
This study examines legal protection for teachers in carrying out their profession as well as the classification of violence against students from a legal perspective. The background of this research stems from the increasing number of alleged cases of teacher violence against students, which has sparked debate between child protection and the authority of teachers to discipline students. The study employs a statute approach with a normative legal research method, analyzing primary, secondary, and tertiary legal materials. The findings indicate that teachers are entitled to legal protection as long as their actions are carried out within the scope of their professional duties and in accordance with applicable laws, while actions that exceed reasonable limits can be categorized as violence with criminal consequences. This research emphasizes the need for clear boundaries between disciplinary actions and violence, as well as the importance of preventive policies through legal education for teachers and the adoption of positive discipline approaches.
