PERLAKUAN HUKUM BAGI NARAPIDANA RESEDIVIS : ANCAMAN HUKUMAN RESIDIVIS

Abstrak

Residivis merupakan seseorang yang Kembali melakukan kejahatan sejenis atau oleh undang-undang dianggap sejenis yang tidak lewat dari waktu lima tahun. Ketentuan residivis ini termuat di dalam Buku ke-II BAB XXXI KUHP. Residivis merupakan salah satu alasan pemberat pidana, di mana penjatuhan pidananya ditambah sepertiga dari ancaman pidana maksimalnya. Pemberatan pidana terhadap residivis dapat berlaku apabila telah memenuhi syarat adanya recidive. Dalam putusan hakim yang tetap atas perbuatan yang sama atau oleh undang-undang dianggap sama, putusan ini menjadi pembeda antara recidive (pengulangan) dengan concursus (perbarengan). Seorang residivis kerap diberi cap sebagai penjahat kambuhan. Tak jarang, ia juga dilabeli sebagai penjahat yang suka keluar masuk rumah tahanan atau penjara. Di Rutan/Lapas narapidana residivis sering dijumpai, mereka melakukan hal tersebut dengan berbagai alasan, salah satunya karena tuntutan kebutuhan hidup yang terus meningkat sehingga membuat mantan narapidana menghalalkan segala cara untuk memenuhinya.

A recidivist is someone who re-commits a similar crime or is considered similar by law within a period of not more than five years. The provisions for recidivism are contained in Book II, Chapter XXXI of the Criminal Code. Recidivism is one of the reasons for aggravating the sentence, where the sentence is increased by one third of the maximum sentence. The aggravation of the sentence for a recidivist can apply if the requirements for recidivism have been met. In a judge's decision that is final for the same act or is considered the same by law, this decision differentiates between recidivists (repetition) and concursus (concurrent). A recidivist is often labeled as a repeat offender. Not infrequently, he is also labeled as a criminal who likes to go in and out of detention centers or prisons. In detention centers/prisons, recidivist prisoners are often found, they do this for various reasons, one of which is because the demands of the needs of life continue to increase so that former prisoners justify any means to fulfill them.
