ANALISIS SOSIOLOGI HUKUM TERHADAP IMPLEMENTASI RESTORATIVE JUSTICE DI INDONESIA

Abstrak

Penelitian ini bertujuan menganalisis implementasi restorative justice di Indonesia dalam perspektif sosiologi hukum. restorative justice menekankan pemulihan hubungan antara pelaku, korban, dan masyarakat serta mencerminkan nilai-nilai musyawarah dan keadilan sosial yang hidup dalam masyarakat Indonesia. dalam praktiknya, pendekatan ini telah diakomodasi oleh aparat penegak hukum, namun masih menghadapi berbagai kendala, seperti perbedaan pemahaman, keterbatasan pengaturan, dan kuatnya paradigma penghukuman. dari perspektif sosiologi hukum, keberhasilan restorative justice sangat dipengaruhi oleh keselarasan antara hukum formal dan nilai sosial masyarakat. oleh karena itu, diperlukan penguatan implementasi melalui dukungan kebijakan, peningkatan kualitas aparat, serta keterlibatan aktif masyarakat guna mewujudkan sistem peradilan yang lebih humanis, adil, dan responsif.

This study aims to analyze the implementation of restorative justice in Indonesia from a sociological perspective. restorative justice emphasizes restoring relationships between perpetrators, victims, and the community and reflects the values of deliberation and social justice inherent in Indonesian society. in practice, this approach has been embraced by law enforcement officials, but still faces various obstacles, such as differing understandings, limited regulations, and a strong punitive paradigm. from a sociological perspective, the success of restorative justice is strongly influenced by the alignment between formal law and societal values. therefore, strengthening its implementation through policy support, improving the quality of officers, and active community involvement is necessary to create a more humane, just, and responsive justice system.
