Abstrak

Sertifikat Laik Operasi (SLO) merupakan instrumen hukum administrasi dalam sistem ketenagalistrikan yang berfungsi memastikan instalasi tenaga listrik telah memenuhi persyaratan teknis dan keselamatan sebelum dioperasikan. Pengaturan mengenai SLO telah diakomodasi dalam berbagai peraturan perundang-undangan, tetapi belum mengatur secara tegas mekanisme pertanggungjawaban hukum apabila instalasi yang telah memperoleh SLO tetap menimbulkan kerugian bagi masyarakat. Kondisi tersebut menunjukkan adanya kesenjangan antara fungsi preventif SLO sebagai instrumen pengawasan dengan fungsi represif berupa pemberian perlindungan hukum kepada korban. Penelitian ini bertujuan untuk menganalisis kedudukan Sertifikat Laik Operasi dalam sistem hukum administrasi negara, mengkaji faktor penyebab tidak adanya pertanggungjawaban hukum dalam pengaturan SLO, serta merumuskan model penguatan perlindungan hukum berbasis risiko dalam sistem ketenagalistrikan Indonesia. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, pendekatan perbandingan, dan pendekatan kasus sebagai pendukung. Bahan hukum diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, literatur hukum, dan jurnal ilmiah yang dianalisis secara kualitatif dengan metode preskriptif. Hasil penelitian menunjukkan bahwa pengaturan SLO masih berorientasi pada pemenuhan aspek administratif dan verifikasi teknis tanpa disertai pengaturan mengenai distribusi pertanggungjawaban hukum ketika terjadi kegagalan instalasi yang mengakibatkan kerugian. Ketiadaan pengaturan tersebut merupakan bentuk regulatory failure karena regulasi belum mampu mewujudkan perlindungan hukum yang efektif, kepastian hukum, dan akses terhadap keadilan bagi masyarakat. Penelitian ini menawarkan rekonstruksi pengaturan SLO melalui penerapan model pertanggungjawaban berbasis risiko (risk-based liability) yang mengintegrasikan fungsi sertifikasi teknis dengan mekanisme pertanggungjawaban hukum dan kompensasi bagi korban. Model tersebut diharapkan mampu memperkuat sistem perlindungan hukum dalam penyelenggaraan ketenagalistrikan sekaligus meningkatkan efektivitas hukum administrasi negara di Indonesia. Argumentasi tersebut dikembangkan dari persoalan utama yang diidentifikasi dalam tesis, yaitu belum adanya mekanisme pertanggungjawaban hukum yang memadai dalam sistem Sertifikat Laik Operasi.

The Safety Operation Certificate (Sertifikat Laik Operasi—SLO) serves as an administrative legal instrument within Indonesia's electricity regulatory system to ensure that electrical installations comply with technical and safety standards before being operated. Although the SLO functions as a preventive mechanism to minimize potential hazards, the existing regulatory framework does not explicitly establish legal liability when certified electrical installations subsequently cause losses to the public. This regulatory deficiency creates a disparity between the preventive function of administrative supervision and the repressive function of legal protection, thereby raising concerns regarding the effectiveness of public legal protection within Indonesia's electricity sector. This study aims to analyze the legal position of the Safety Operation Certificate within the Indonesian administrative law system, examine the factors contributing to the absence of legal liability in the SLO regulatory framework, and formulate a risk-based liability model to strengthen legal protection for the public. This research employs normative legal research using statutory, conceptual, comparative, and case approaches. Legal materials consist of primary, secondary, and tertiary legal sources collected through library research and analyzed using qualitative and prescriptive legal methods. The findings indicate that the current regulation of the Safety Operation Certificate primarily emphasizes administrative compliance and technical verification without providing a clear legal responsibility framework when certified electrical installations result in damage or loss. This condition constitutes a form of regulatory failure, as the existing regulatory framework has not effectively ensured legal certainty, public protection, or access to justice for affected parties. Accordingly, this study proposes the reconstruction of the Safety Operation Certificate regulatory framework through the adoption of a risk-based liability model that integrates technical certification with legal accountability and compensation mechanisms. Such a model is expected to enhance legal protection, reinforce accountability within the electricity sector, and improve the effectiveness of administrative law in Indonesia. The article develops this argument from the central issue identified in the thesis, namely the absence of an adequate legal accountability mechanism within the current Safety Operation Certificate system.
