IMPLEMENTASI PRINSIP CHECK AND BALANCE DILIHAT DARI PROSES PEMBENTUKAN UNDANG-UNDANG NOMOR 6 TAHUN 2023 TENTANG UNDANG-UNDANG CIPTA KERJA

Abstrak

Pemisahan kekuasaan dipisahkan kedalam negara yang sederajat sehingga diperlukan sarana untuk mengontrol atau membatasi kekuasaan tersebut agar dapat berjalan dengan semestinya. Sarana tersebut ialah hukum, yang digunakan sebagai pembatas bagi penguasa untuk tunduk pada hukum. Ini merupakan sarana (checks and balances), baik konstitusional maupun institusional. Mekanisme checks and balances dalam proses pembentukan undang-undang berdampak positif mencegah dominasi dari salah satu lembaga sehingga tidak memberikan kesempatan untuk kekuasaan yang absolut. Rumusan permasalahan yang dihadapi adalah Bagaimana Mekanisme Pembentukan Undang-Undang Dalam Sistem Ketatanegaraan Indonesia, Bagaimanakah implementasi Prinsip Check And Balance Dilihat Dari Proses Pembentukan Undang-Undang Nomor 6 Tahun 2023 tentang UU Cipta Kerja. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif dengan sifat penelitian deskriptif yang menjelasakan bagaimana implementasi Prinsip Check And Balance Dilihat Dari Proses Pembentukan Undang-Undang Nomor 6 Tahun 2023 tentang UU Cipta Kerja. Adapun metode penelitian library research,menggunakan data sekunder diolah dengan metode analisis kualitatif. Hasil penelitian, diketahui Proses perancangan dan pengesahan Undang- Undang Nomor 11 Tahun 2020 tentang Cipta Kerja tidak sesuai dengan Undang- Undang No.15/2019 tentang Pembentukan Peraturan Perundang-Undangan karena pada tahapan perencanaan dan penyusunan ternyata Naskah Akademik dan Dasar Penyusunan pada Program Legislasi Nasional Tahun 2020 tidak memiliki kekuatan hukum, begitu pula dengan teknik penyusunan pembentukan peraturan perundang-undangan yang tidak sesuai hukum.. Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Perppu Nomor 2 Tahun 2022 tentang Cipta Kerja tidak mencerminkan adanya prinsip Check and Balance dalam pembentukan Undang- Undang Nomor 6 Tahun 2023 tantang Cipta Kerja karena dapat dilihat bahwa Eksekutif dan Legislatif satu suara atau seperti dipegang oleh satu lembaga. 

The separation of powers is separated into equal states so that means are needed to control or limit these powers so that they can run properly. This means is the law, which is used as a barrier for the authorities to obey the law. This is a means (checks and balances), both constitutional and institutional. The checks and balances mechanism in the law formation process has a positive impact on preventing the domination of one institution so as not to provide opportunities for absolute power. The formulation of the problem faced is: What is the mechanism for forming laws in the Indonesian constitutional system, how is the implementation of the Check and Balance Principle seen from the process of forming Law Number 6 of 2023 concerning the Job Creation Law. The type of research used is normative juridical legal research with the nature of descriptive research which explains how the Check and Balance Principle is implemented in view of the process of forming Law Number 6 of 2023 concerning the Job Creation Law. The library research research method uses secondary data processed using qualitative analysis methods. As a result of the research, it is known that the process of designing and ratifying Law Number 11 of 2020 concerning Job Creation is not in accordance with Law No. 15/2019 concerning the Formation of Legislative Regulations because at the planning and drafting stage it turns out that the Academic Manuscript and Basis for Preparation of the Legislation Program The 2020 National Regulations do not have legal force, nor do the techniques for drafting the formation of statutory regulations that do not comply with the law. Law Number 6 of 2023 concerning the Determination of Perppu Number 2 of 2022 concerning Job Creation does not reflect the principle of Check and Balance in the formation Law Number 6 of 2023 challenges Job Creation because it can be seen that the Executive and Legislative have one voice or are held by one institution.
